A Few Operating Issues: Relocating and Go Dark Rights

This paper considers two operating issues: relocation rights and issues concerning tenant's Right to go dark.

A. RELOCATION CLAUSES

1. A relocation clause allows a landlord to move a tenant from its original location to other premises in the same building or shopping centre or complex. In both the retail and office context, relocation clauses are of great importance to a landlord as they permit the landlord to remerchandise and/or expand its property- all with minimal interference from uncooperative tenants.
