Landlords often require that tenants deliver WSIB clearance certificates from contractors engaged in the improvement of the tenant’s premises. It is not uncommon for the delivery of these certificates to be a pre-condition to payment of a tenant allowance. While most landlords and tenants are aware that, where these certificates are not obtained there is potential liability for each of them, these liabilities are not well understood.
